Agreement to Terms
By engaging Apex Building Estimates ABN 36 660 532 258 ("we", "us", "our") to provide services, or by using our website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or website.
Our Services
Apex Building Estimates provides independent building assessment services including:
- Fair & Reasonable Reviews — independent verification of contractor quotations prior to repair
- Audit Reviews — post-repair assessment of contractor invoices and variation reports
- Contractor engagement and negotiation on behalf of clients
- Reporting and documentation in connection with insurance claims
Engagement and Instructions
Services are provided on instruction from authorised clients (insurers, TPAs, underwriting agencies, brokers, or fleet companies). Each instruction constitutes an agreement to these terms. We reserve the right to decline any instruction at our discretion.
You are responsible for ensuring that all information and documentation provided to us is accurate and complete. We rely on the information provided to produce our assessments and accept no liability for errors arising from inaccurate or incomplete instructions.
Fees and Payment
Our fees are based on a fixed fee per claim as agreed at the time of engagement. Fees are invoiced upon delivery of the assessment report. Payment terms are 30 days from the date of invoice unless otherwise agreed in writing. We reserve the right to suspend services for overdue accounts.
Delivery Timeframes
We aim to acknowledge all instructions within 24 hours and deliver assessment reports within 48 hours of receiving complete documentation. Timeframes are targets only and may vary depending on the complexity of the claim or availability of documentation. We will notify you of any expected delays.
Independence and Objectivity
Apex Building Estimates operates as an independent assessor. We have no commercial affiliation with any contractor, repairer, or supplier. Our assessments represent our professional opinion based on available information, current market data, and industry benchmarks.
Intellectual Property
All assessment reports, methodologies, templates, and materials produced by us remain our intellectual property unless otherwise agreed in writing. You are granted a non-exclusive licence to use reports for the purposes for which they were commissioned. Reports must not be shared with third parties without our prior written consent.
Confidentiality
We treat all claim information and client data as confidential. We will not disclose information to third parties except as necessary to perform our services, or as required by law. Clients are also expected to treat our reports and pricing as confidential.
Limitation of Liability
Our assessments represent professional opinions and are not guarantees of outcome. To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the fees paid for the specific engagement giving rise to the claim. We are not liable for any indirect, consequential, or economic loss.
Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
Changes to These Terms
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. The date of the most recent revision is shown at the top of this page.
